Stay-At-Home Order Extended and Evictions and Foreclosures in Pennsylvania Stayed Until July 10th

Previously, as part of its statewide judicial emergency, the Pennsylvania Supreme Court had ordered all evictions and foreclosures stayed through May 11, 2020. Governor Wolf made specific note of that deadline in his Order and extended the suspension another sixty (60) days until July 10th. The pre-foreclosure notices required by Pennsylvania state law under Act 6 and Act 91 are likewise stayed for sixty (60) days from May 11th. Likewise, all notices of eviction under the Landlord-Tenant Act of 1951 are stayed for sixty (60) days from May 11th. As of July 10, 2020, unless subsequently ordered otherwise, both foreclosure and eviction proceedings may resume.
In regards to pending foreclosure and eviction matters that were previously filed, the Court of Common Pleas of Philadelphia County and Municipal Court remain closed through May 29th and any trials and/or hearings that had been scheduled between March 16th and May 29th have been postponed. For those landlords who had previously obtained judgments for possession, the issuance and execution of residential writs of possession to evict are stayed through June 1, 2020.
The Philadelphia Sheriff’s Mortgage Foreclosure Sale scheduled for June 2nd and all Philadelphia Tax Sales scheduled for June have been postponed to September.
